Terms of Service
Swift Serve Pro
Last updated October 20, 2026
These terms are an agreement between you and Swift Serve Pro (“we” or “us”), based in Florida, USA. They apply to everyone who uses the Swift Serve Pro app — on the web or on iPhone and iPad — including business owners, office staff and field techs.
If you use the app for a business, you agree to these terms for yourself and for that business. If you don’t agree, please don’t use the app. Our Privacy Policy explains how we handle data.
1. The service
Swift Serve Pro helps home-service businesses run their work: customers, scheduling, estimates, invoices, payments, texting, calls, email, photos and marketing. Some features need an outside account, like a texting number, a payment processor or a website. We may add, change or remove features over time.
2. Accounts and approved logins
- A business is set up by its owner. The owner adds staff and approves each login, and nobody gets into a business without that approval.
- You can sign in with Google, with Apple, or with a code we email you. Keep your sign-in secure. You’re responsible for what happens under your login, so tell us right away if you think someone else is using it.
- Owners are responsible for who they approve, the role they give each person, and removing people who should no longer have access.
- To set up a business you must be at least 18 and have the authority to agree to these terms for the business.
- Give us accurate information, and keep your business’s details up to date.
3. Your business’s data stays yours
- Your business owns its data: its customers, jobs, photos, messages and records. We don’t claim ownership of it.
- You give us permission to store, process, send and show that data only as needed to run, secure and support the app for you, including through the service providers listed in our Privacy Policy.
- You’re responsible for having the right to put that data in the app, and for your own customer privacy policy. The app gives every business a customer-facing privacy policy page you can use.
- You can ask us for a copy of your business’s data, or to delete it, by emailing support.
4. Texting, email and acceptable use
You’re responsible for the texts, emails and other messages your business sends through the app. That means:
- Get your customers’ consent before you text or email them, and keep a record of it, as the law requires.
- Follow the laws and rules for texts, calls and email, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state laws, and phone-carrier rules (like texting-number registration).
- Honor opt-outs. The app stops texts after a STOP reply and stops marketing email after an unsubscribe; don’t try to get around that.
- No spam, no bought or scraped contact lists, and no messages that are illegal, misleading, harassing or hateful, or that violate someone else’s rights.
- Follow the law on recording calls and voicemails where you operate.
Also, don’t:
- try to get into another business’s data or anyone else’s account;
- test, probe or get around the app’s security or limits;
- overload the app, or copy, reverse-engineer or resell it without our written OK;
- upload anything illegal or harmful, like malware.
We may pause texting, email or an account that puts the app, phone carriers, other businesses or the public at risk — for example, after spam complaints.
5. Payments you take from customers
Card and bank payments from your customers go through Stripe or Helcim, using your business’s own account with them, under that company’s own agreement and fees. We aren’t a party to those payments and never hold your money. Holds, disputes, chargebacks and refunds are between you, your customer and your processor.
The same goes for the other outside services you connect (like texting, email, bank feeds, postcards, Google, Facebook, Instagram or your website): their own terms apply, and some charge their own fees.
6. Fees and billing
Any fees for using Swift Serve Pro are the ones shown when you sign up or in the app. If we start charging for something that’s free today, or change a price, we’ll tell you ahead of time, and you can stop using the app before the change applies. Taxes may apply.
7. AI features
- Some features use AI to draft messages, posts, emails and website pages, to suggest things like labels or receipt details, and to find faces, license plates and house numbers in photos so they can be blurred.
- AI features run for a business only after its owner agrees in the app. The owner can turn them off in Settings, and they may pause when a business reaches its monthly AI limit.
- AI can be wrong or incomplete. Review every draft and suggestion before you use, send or publish it. You’re responsible for what your business sends and publishes.
8. Our app
The app, its software, design and name belong to us. While these terms apply, we give you a limited, non-exclusive, non-transferable right to use it for your business. If you send us ideas or feedback, we may use them without owing you anything.
9. Availability
We work hard to keep the app running, but we can’t promise it will always be available, fast or free of errors. It can be affected by maintenance and by outside services like phone carriers, payment processors and hosting providers. Texts and emails can be delayed or not delivered for reasons outside our control. Keep your own copies of anything critical.
10. The app is provided “as is”
To the fullest extent the law allows, the app is provided “as is” and “as available,” without warranties of any kind, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement.
11. Limits on our liability
To the fullest extent the law allows, we won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim about the app is limited to the greater of what your business paid us for the app in the 12 months before the claim, or $100. Some states don’t allow some of these limits, so they may not all apply to you.
12. Your responsibility for claims
If someone makes a claim against us because of your business’s messages, data, customers, or use of the app in breaking these terms or the law (for example, a texting-consent claim), your business agrees to cover our reasonable costs and losses from that claim, including lawyers’ fees.
13. Ending your use
- You can stop using the app at any time. Anyone can delete their own account in Settings → This phone → Delete my account.
- If the only owner of a business deletes their account, the business closes and its data is erased 30 days later, as our Privacy Policy explains.
- We may suspend or end access if you break these terms, if the law requires it, or to protect the app, other businesses or the public. When it’s reasonable, we’ll tell you first and give you a chance to fix the problem or get a copy of your data.
- Sections 3, 5 and 10 through 15 keep applying after your use ends.
14. The iPhone and iPad app
If you got the app from Apple’s App Store, these terms are between you and us, not Apple. Apple isn’t responsible for the app or its support, and Apple’s own App Store terms also apply to how you download and use it.
15. Florida law
These terms are governed by the laws of the State of Florida and of the United States, without regard to conflict-of-law rules. Any dispute about the app or these terms will be handled in the state or federal courts located in Florida.
16. Changes to these terms
We may update these terms. We’ll post the new version here with a new “Last updated” date, and for important changes we’ll tell you in the app or by email before they take effect. Using the app after a change means you accept the new terms.
